| Note to all Citizen Board Committee Members: Section 112.3145(1)(a), Florida Statutes, lists those officers who are required to file statements of financial interests. Section 112.3145(2)(b) requires that the first financial disclosure statement be filed within 30 days of appointment or employment, and Section 112.3145(7)(a) requires that notification of the obligation to file this initial disclosure be provided by the appointing official or body. Such notification is required to be given no later than the date of appointment or the date employment begins. Section 112.3145(7)(b) allows the appointing body to designate a person responsible for these notification requirements. After the initial filing (within 30 days of appointment or employment), local officers are required to file annual financial disclosure if office was held at December 31st (Due July 1, 2010). The law further states that each local officer shall file a final statement of financial interests within 60 days after leaving his or her public position, unless, within that 60-day period, the person takes another public position for which financial disclosure is required. Penalties of $25 per day up to $1500 for failure to timely file annual disclosures are assessed. Finally, section 112.3145(6) mandates that the Commission prepare a current list of names and addresses of all persons required to file financial disclosure. This list is then used to mail forms and instructions to filers, and to determine who has failed to file and is subject to automatic fines. The forms and instructions for filing disclosure (CE Form 1), as well as the forms and instructions for filing the final disclosure (CE Form 1F), may be downloaded from the following website: www.ethics.state.fl.us |
